And it happened: Berlusconi was not condemned



So you have a crime that was ascertained: a rich man had bribed a witness to influence his depositions. The person bribed was condemned. The corrupter was not. http://aprile25.blogspot.com/2012/02/berlusconi-is-innocent.html#links
The condemned one was one of Berlusconi's lawyers. The corrupter was Berlusconi.
The Tribunal had the choice of acquitting Berlusconi or of declaring that the terms for judging the crime had expired.
The Tribunal chose the second option an indirect way to declare that it had found Berlusconi guilty but could not condemn him due to the terms that had expired. Why so ? because of the laws Berlusconi had promulgated to reduce the terms for judging certain crimes and because his lawyers successfully managed to delay the proceedings.

But Belrusconi was found guilty ! He escaped once more but we will get him with other pending trials.

BERLUSCONI IS INNOCENT !


Once again today, Berlusconi will be acquitted for witness corruption charges.

A British lawyer, M. Mills, was already condemned for being bribed by Berlusconi for making false declarations. In other words, Berlusconi was already found guilty, indirectly.

He could not be judged at the same time as his lawyer, because of the many laws in his favor he made his Parliament approve, like in any Banana Republic. But now the trial arrives to an end.

The judgement is expected today. And it will be acquittal because the terms have expired, not because he is not guilty.

The terms have expired because of the laws he made the Parliament approve to shorten the terms and to declassify the crime of corruption. All laws in his favor only.

In other civilized countries, the terms expire if no trial has commenced. Once the trial has started, the terms do not expiry. Not in Italy. So if you are a politician or if you are rich, you can manage to pay good lawyers who know how to delay the judgement until the terms have expired.

B (like Banana or Berlusconi) republic.

What Berlusconi fears, however, is that the Tribunal will acquit him with a statement to the effect that although guilty he cannot be condemned due to the terms that have expired. He is scared to death and has kept issuing all kind of declarations these days.

Because there are other trials going on and this one can be the first of many where the judges state that he is guilty.

Let us see what will happen.....

About corruption

"Illegality, corruption and crooks are still very much a reality in the country" stated yesterday the Italian GAO President Giampaolino. And this 20 years after the scandal of Mani Pulite (clean hands) exploded and Craxi, then Prime Minister, Berlusconi's protector, had to leave Italy in voluntary exile in Tunisia, after stating that what he had done was the norm.

The same day the GAO President makes public his concerns, she does not find anything better than to state that the "Clean Hands" investigations that brought to light the extensive corruption of the Political class in Italy, in fact created major damages to the country leading to a "civic and moral decay" of Italy.

She really has no shame, possibly because she regrets not having had the possibility of getting as rich as her father through corruption. And she was a distinguished representative of Berlusconi's government...

BERLUSCONI'S ITALY AND BEN ALI

There was a Prime Minister, socialist he called himself, named Craxi.

In 1984, as Prime Minister, he issued a decree to legalize the illegal operations of Berlusconi's televisions. The decree was approved in 1985 and we know what happened since then.

In 1985, he got concerned about the tensions between Algeria and Tunisia.

The Italian secret service, in consultation with the Libyan and Algerian authorities, identified a named Ben Ali as a possible solution to the growing crisis in Tunisia.

In 1987, with the help of the Italians, Ben Ali became president. Craxi was no longer a Minister but was the leader of a party member of the Government. According to many sources, and in particular the former chief of the Italian Secret Service, it was Craxi the main master of such coup d'état.

In 1991, it was discovered that he had received 20 billion liras (a hell of a lot of money then) on a secret account in Switzerland...

That was the tip of the iceberg of the corruption of the man who had elevated it to a system of government. But the justice, that same that Berlusconi now attacks, went after him.

In 1994, after demonstrations in the streets, harsh criticism in the press and a loss of parliamentary immunity, he escaped to Tunisia where he lived a luxurious life (thanks to the money he had collected illegally), under the protection of Ben Ali, until he dies in 2000.

During the recent Tunisian crisis, the TG1 (main news on public TV in Italy, directed by a servant, or better prostitute, of Berlusconi was broadcasting a service from its correspondent in Tunisia who was describing how corrupt, violent and anti-democratic was Ben Ali. Suddenly the broadcast was stopped for no reason (normally they apologize for technical problems). Shortly after, the same TG did broadcast an interview during which the interviewed person praised Ben Ali, what he had done the economic development of Tunisia and so on and so forth...

The person interviewed was the vice-minister for Foreign Affairs (and of course the Minister did not contradict her subsequently)

Her name: Stefania CRAXI. Craxi? Yes, the daughter of Bettino Craxi, the crook who helped Berlusconi.

A full circle....a shameful demonstration of the intellectual corruption, to say the least, of Berlusconi and his clique and of his Minister for Affaris, Frattini.

MUGABERLU


By now, Italy has become a real banana republic. And MUGAbe is getting a fair complexion when he compares himself to BERLUsconi.

Think at this:

Nineteen laws approved by the Parliament to protect Mugaberlu and one more in under discussion.

Out of 14 trials:
One was archived;
4 times Mugaberlu was acquitted;
once he was acquitted because in the meantime his government had passed a law establishing that forged accounts, the crime he was accused of, were no longer a crime;
5 times he was acquitted because the time limit had been shortened by his government;
2 are ongoing (and in one his lawyer was already recognized guilty of corruption on his behalf);
One is under instruction.

Mugaberlu continues to control television and a large part of the press. Public TV considers that being public means being the Master’s voice. To the point that they broadcast false information (Mugaberlu’s lawyer was “acquitted” they said instead of saying that he had been found guilty of corruption (and condemned to pay a huge fine) on behalf of Mugaberlu, but that he could not be prosecuted due to the shortened time limits imposed by Berlusconi himself. Worse, the majority of the channel journalists defended the director of information, and the TV CEO, appointed by Mugaberlu, refused to meet the representatives of 150,000 citizens who had called for sanctions against the Director of information.

Mugaberlu’s servants imposed the suspension of any political debate on public TV (there are practically none on his channels) before elections, to avoid criticisms.

The main Italian publisher, Mondadori, that belongs to Mugaberlu, refused to publish a book by Sepulveda , who was under contract with them, as too critical of Berlusconi himself.

Italy, in spite of its ratifying the UN conventions on corruption and the OECD Convention against bribery, made corruption a little more than a misdemeanor and shortened the time limits . At the same time, Mugaberlu and his allies celebrate Mr. Craxi, a former socialist Prime Minister, a good friend of his, who instead of facing the justice went on voluntary exile in Hammamet (Tunisia), a tourists’ paradise, after an (in)famous speech at the House stating that what he had done (corruption officially to finance his party) had been done by everybody (omitting to say that he had also become rich through corruption).

Allegedly to protect the privacy of citizen, as if the majority of citizen would be subject to wiretapping, in fact to protect himself and his combinazione allies, and the Mafiosi, Mugaberlu is pushing for a law that would de fact make it impossible for judges and police to wiretap suspected criminals. His Mafia friends are applauding.

Mugaberlu extended the concept of “emergency”, applicable to natural disasters to facilitate bureaucratic procedures, to “special events” such as the celebrations for a Saint, the World swimming championships in Rome, the 150 years of Italian unity (a date known since 150 years only thus justifying the emergency and urgent measures ) to the point that a small clan of friends of his right hand (the same who said that the Americans were lousy in the rescue of Haiti) Bertolaso made money without any control (now under investigation by the Justice).

The scandals with prostitution (women and men) continue to be revealed. And his taste for young women was confirmed with the presence at the next elections of his personal dental hygienist, Nicole Minetti, he met last December only after the “attack” he was the victim of.

Mugaberlu continues in his attempts to destroy the checks and balances system of the democracy, by attacking the independence of judges, the President of the Republic, the opposition. His concept of democracy is totalitarian: majority has all rights, minority can exist if it agrees with him. His last creation : a retroactive decree that determines what the time limit means for presenting electoral lists. His slaves, apparently to accommodate his last minute wishes to change the lists to be presented, did it after the time had ended (Rome). Or had not presented the minimum number of valid signatures (Milan). But Berlusconi and his advisers changed the rules that had always applied, just to cover the cases of his party, while many other parties had been rejected but no retroactive law was issued to reinstate them.
His coalition applauded a senator who had been forced to resign, not to be kicked out from Parliament, for false statements, for being elected through fraud organized by the Mafia, for being financed by the Mafia.

Pending the approval of another law that would protect him from trials while Prime Minister, he is using all possible delaying tactics to avoid testifying in court, thus hoping to reach the shortened time limit he cooked.

We often hear the Americans, and the Brits and Sarkozy, criticizing, rightly so, leaders (dictators ?) of developing countries for undemocratic behavior. All capitals know what is going on, at least by reading leading newspapers such as The Economist or Le Monde or El Pais, but hopefully through their ambassadors’ reports. Nothing to say about Mugaberlu ? Come on Ms. Clinton, silent for a change ? Wrong time, madam. Soon it will be too late and Italy will no longer be a democracy (is it still one ?). Indeed you are used to get along with dictators such as Mobutu, Pinochet, Argentineans and Brazilian generals, Saudi’s king, and more. So, one more or one less, it does not matter provided you can keep your atomic bombs stored in Italy.

GUILTY




A couple of days ago, the Corte di Cassazione (third grade tribunal) declared that Mr, Mills, a British lawyer, who had been condemned for passive corruption, did not have to be prosecuted because of time limits. But they did recognize the fact that corruption had taken place and condemned Mr Mills to pay about 200,000 $ fine to the Italian government.

He could not be legally prosecuted because of a law, passed by Berlusconi’s government, that reduced the terms of prosecution of corruption from 15 to 10 years.

In other words, Mr. Mills could not be prosecuted because the law on corruption is unenforceable du to time limit.

This is quite different from acquittal which is a judgement of not guilty. Of course.

But the main TV public channel, Rai 1, stated twice, during his main news broadcast, that Mr. Mills had been acquitted (they could not explain however how someone acquitted had to pay 200,000$ of fine).

Is the public channel full of ignorant people who ignore the meaning of words ? possibly. But more likely, they just tried to do a cover up.

Why ? because the corruptor is Berlusconi and the Director of Rai 1, a certain Minzolini, is a slave of the former.

In any other democracy, the Prime Minister, or even a Minister of Member of Parliament, would have resigned. Not in Italy, of course. It is well known that Berlusconi is victimized by Taliban like judges (his statement of 26 February 2010). But GUILTY he remains

MAKE BERLUSCONI A CHINESE CITIZEN

Many people in Italy (and abroad – ask the G8 members not to say the EU leaders) would love to make rid of Berlusconi. But, since, contrary to the latter, they are relatively honest persons avoiding violence, how to do it ?

Some suggested a subscription to offer Berlusconi escorts, so that he could die of exhaustion. But the Church, main beneficiary of the Italian Prime Minister and of the morale of citizens (which, as well known, does not apply to priests etc) objected.

So what to do ?

Here is a solution: make him a Chinese citizen. There people are condemned to death for corruption and fraud. Berlusconi would not last a couple of weeks ! A legal solution to a main problem for the civilized world……….. And a suggestion for Italian judges.

Berlusconi and Bertolaso (see last two posts) , B&B like Beagle Boys.

Berlusconi does not steal money. But he robs the Italians by strengthening his Media empire through laws made to order to protect them and destroy incrementally public TV. And he robs the Italians of democracy by undermining all checks and balances on his government.

Bertolaso does not seem to have stolen money, so far. But it appears clear that he has robbed the Italians by giving without any control hundreds of million of Euros worth of contracts to a small gang of friends, some linked to organized crime. Did he do all this for free ? this is what he pretends. But can we trust someone who is the right hand of Berlusconi in his policy of “doing” ? Wait and see.

In any case together, with their accomplices, B&B are the real Beagle Boys

BERLUSCONI'S LOGIC OF POWER

The world recently discovered Mr. Bertolaso, the alter ego of Berlusconi, his accomplice in the “doing” opposite to the “talking”. The Italians have known him since a long time, unfortunately.

Whenever there is a lot of money involved, public money, the two accomplices “did” things. The “miracle” of L’Aquila, the city destroyed by the earth quake, is Bertolaso’s doing. So the alleged resolution of the garbage emergency in Napoli. Hundreds of million of Euros spent without any control: not even the Corte dei Conti (the equivalent of the US GAO) can look into how the money is spent. And the “emergency commissary”, Bertolaso, cannot be indicted, not even investigated.

So sure of himself, he went to Haiti to criticize the US rescue intervention. Possibly jealous of all what Cheney had done in Iraq, without any control: Bertolaso would love to have all the money Cheney had.

But since a few days, the situation of the “Berlusconi’s hero” is changing: judges and people want to know more about how the public money was spent. During a long investigation, the judges and the police discovered quite a lot of illegal business. Mostly through wiretapping. Funny things including prostitutes who were apparently provided to Bertolaso as a favour .

So what does Berlusconi ? guess !

He declares that Bertolaso should be the Prime Minister and that legal wiretapping under judicial control should be limited when not suppressed.

This is Berlusconi, this is his logic, this is Italy who will vote for him at the end of March….

One month silence on my blog. However, not because there weren’t new facts about my preferred politician, El Berlusca. On the contrary: too much I could not even read everything. His attendance to a party of a young girl who calls him “papi”, his lies about how he met her (4 different versions often supported by his “servants”), his wife asking for a divorce stating that “he is sick and goes out with minors”, the condemnation of one of his former lawyers for corruption (Berlusconi could not be judged thanks to a law he himself made to protect his own interests), pictures and tapes of his night with an “escort”, pictures of almost necked girls in his villa in Sardinia, pictures of girls on his private boat (duly escorted by the Carabinieri….), …..

All this already published on most international press, from the New York Times to the Financial Rimes, to El Pais etc.

And 10 questions to him, who consistently refuses to be interviewed by journalists who do not work for his company, still unanswered since 2 months. And 10 new questions….which will remain unanswered.

What to add to all what the press (only part of the Italian press, almost all international reference press) already reported ? Thus my silence.

Time however has come for me to start again, hoping that someone will start reading me again.

A baby sitter state


The Independent, in an article dated 18 August, states that a “tempest” of new laws and rules are making Italy “the greatest baby-sitter state” with citizens considered as babies to control and protect.

The author, Peter Popham, shows a better understanding of Italy than his colleague, Italian…of Newsweek.

Indeed, Berlusconi won the elections due to the total lack of communication strategy of the Prodi’s government and also sailing on security: against immigrants, illegal and legal who are however essential to the economy -most are employed by good Italians…who complain, against rapes committed by immigrants while there is more local violence, who want “cleaner” cities and forget the real criminality, the Mafia.

Even the Catholic magazine for excellence, Famiglia Cristiana, the weekly with the largest distribution in Italy (one million copies per week), wrote about the risks of fascism in view of the laws promulgated by the Lega North interior Minister with the blessing of Berlusconi. And they were defined “crypto communists” by Government officials.

Increasing police power is given to majors who are incompetent in this area and take all kind of stupid measures, especially in the areas controlled by the Lega Nord and in Rome, with a hard neo-fascist major. And the Minister of Interior tries to undermine in this way the role and authority of “prefetti”, the government representatives in the field, who report to him. Competent, trained, devoted to the State. Contrary to the lord majors devoted to their local little interests for their re-election.

The Independent points out that Berlusconi claims that he will simplify the governance of Italy, and created a Ministry for that, while he allows his interior Minister to pass decrees that on the contrary increase rules, local laws, decrees that make a mess of the situation. Soon one, before entering a city will have to stop for ten minutes to read panels listing all what is forbidden…. Making me regret the simple posters in Louisiana and Mississippi, for example, reminding citizen that it is forbidden to carry fire arms on the beach or on university campuses.

It is interesting to read what Peter Pohpman* wrote about his article that made the Italian Press and politicians cry wolf: “(…) many years ago I got in love with Italy (…) discovering a country that merged elegance and freedom, beautiful natural sceneries and beautiful art created by man, tolerance a tradition of informal ways of living, the clear result of an ancient civilization, (apparently) mature. If now, on the Independent I talk about the many new laws promulgated in Italy to ban informality and limit freedom, it is because I am very sad in noticing that in this way civilization id regressing, substituted by the big shoes and rifles of a police state.(…). Berlusconi took power thanks to “the security emergency” But the real security emergency is and existential emergency, which lives in the mind of people when it reacts in a panic mode to a world that is suddenly changing. Italy has many serious social problems, but instead of looking for long term solutions (…), those who have the power promulgate hundreds of laws and rules little thought of aiming at giving the impression that they take concrete steps and puts the army in the streets. (…) In Italy, like in the UK, the true victims of a police state are the citizens”.

He said it all.

Miracle ? no sir, yu’re wrong



Newsweek, in a surprising article dated 89 August, talk about miracles allegedly made by Berlusconi during his first 100 days in power (this time…).

But, apart from the “emblematic” cleaning of garbage in Naples, I already commented favorably myself sharing the however the questions mark of the author, all what he quotes has nothing of a miracle.

A law to protect himself from well advanced judicial trials cannot be a miracle. Attempting to destroy the judicial system for his own personal interests is not a miracle, is danger for democracy, everywhere, including in Pakistan. But the author does not mention it.

Putting 3000 soldiers in the streets (about 700 at any point in time) when Italy already has more than 400,000 police and other security personnel is pure bullshit. Useful as propaganda but diverting the attention to small larceny while the plague is the real crime, the Mafia, the N’drangheta, the Camorra who increase daily their grip on Italian economy recycling their capitals.

As the Independent recently pointed out, Berlusconi is destroying the state thanks to the Lega Nord Ministers who give more and more power to unprepared lord mayors on security matters and more funds to the rich regions sinking even more the corrupt South thanks also to the absolute absence of the neo-fascist former Alleanza Nazionale too keen to stay in power and unable to face the blackmail of the Lega Nord essential for them to stay in power: suppressing a tax that was the main source of income for a the all municipalities without knowing how to compensate the lack of resources; dealing with his own legal problems instead of giving priority to the economy which is collapsing; staying silent on Georgia (he phoned his friend Putin, the same one he had once declared that he is a “real democrat”…)

In spite of the title of the article and six long paragraphs praising Berlusconi, the author, a certain Jacopo Barigazzi, ends it with these two sentences: “Italians like him (Berlusconi) now, but what they really want is economic stability. Cleaning up trash and harassing immigrants won't be enough.” So why such a title?

Ethics Italian style - 1


The Italian industrialists association ( Confindustria) was lead until a few months ago by Luca Cordero di Montezemolo, Ferrari’s president. Although he liked too much to play the one who knows everything, giving lessons to everybody, his attitude towards mafia and corruption were a breath of fresh air and remarkable. He denounced tax evaders and expelled from the association firms that had paid “il pizzo”, a “voluntary” contribution to Mafia, what people call in Sicily insurance”.

Another leading member of the industrialists association, Mr Della Valle, even told Berlusconi what he thought of him, in front of the other industrialists.

He was succeeded by Ms Marcegaglia who, on the contrary, is like a carpet in front of Berlusconi. Of course Berlusconi wants to forbid wiretapping for corruption, for example, and bankruptcy. And this is personally welcome by Ms Marcegaglia whose group recently reached a judicial agreement in the amount of 750,000 € (1.150,000 $) of fine and of 5.5 millions € (7.75 million $) of money seized and 11 months jail term for Ms,. Marcegaglia’s brother. Why ? Corruption of managers of a state owned company to win a contract.

Are these the ethics of Italian industrialists ? Is Ms. Marcegaglia representative of their way of doing business ?

Dio li fa e poi li accoppia (God makes them, then puts them together ) Italians say. No wonder she loves Berlusconi.

Monica for Minister


In the course of investigations for corruption involving, guess who, Berlusconi, the judges apparently recorded some very very private telephone conversations he had with some beautiful ladies he subsequently appointed Ministers by him in spite of their lack of basic competencies.

This made an Italian MP state : “Not even Clinton dared to make Monica a minister”. Indeed, Berlusconi seems to be even more powerful than a US President…. Viva l’Italia !

Security First


One of the main arguments that brought Berlusconi again to power was “security”. A traditional subject used by the right and exploited to an unbelievable point by Berlusconi’s allies, former and current fascists.

The Italian economy is collapsing, taxes were not reduced as promised (one was canceled but the money will come from other sources, still from taxes), but promises are made to the Vatican to finance the catholic schools, and the first urgent laws the new Government presented concerned the security: against illegal immigrants, against Roms (including finger printing of kids….), against “legal actions against the 4 highest ranking officials in the State, the President, the Prime Minister, the Speakers of the two houses” and to suspend legal proceedings for crimes not affecting the “security”.

Guess what, both these “special commas” have nothing to do with the security of Italians, but with the legal proceeding initiated since years against Berlusconi. And in particular one, for corruption of judges. Imagine, a Prime Minister soon to be condemned for corrupting judges : and it is not Zimbabwe…it is Italy, it is not Mugabe, it is Berlusconi. In fact the proceedings concerning this crime have progressed to the point and in such a way that it is expected and likely that this time Berlusconi will be condemned. Thus the urgency. And people take it.

What is the most distressing is to see how the allies of Berlusconi, and members of his party, act or better do not react. They are like zombies, no dignity, no nothing. Only interest : keep their well paid job.

And what is even more distressing is that the popularity of Berlusconi is growing while people reduce spending, do not go on vacation, cannot pay their rents, the Italian Central Bank publishes negative economic forecasts, inflation is increasing. At least the Romans gave people “panem and circenses” (bread and games) to make them stand the situation. Now Berlusconi gives people illusion of security, his own, but they do not realize it….and they are happy. Damn it, is democracy still a valid option with people narcotized by stupid TVs ?

Bush apologizes for saying the truth ?


There must be something wrong again in the world. Bush apologizing to Berlusconi just because a biography of the latter stating that he was “hated by many”, seen as a “"regarded by many as a political dilettante who gained his high office only through use of his considerable influence on the national media...". It also stated that Berlusconi was "one of the most controversial leaders in the history of a country known for governmental corruption and vice".

The biography went on to say that Berlusconi was appointed to the prime minister's office in 1994, "however, he and his fellow Forza Italia Party leaders soon found themselves accused of the very corruption he had vowed to eradicate."

Hated by many is an understatement.

That he gained office though his control over the media is a fact

That he is controversial, there is no doubt, just today people demonstarate all over Italy against him.

That he is believed to be corrupt, is a fact: while in the past he managed to be released during law cases mostly due to the good techniques of his lawyers who managed to get the civil suits brought against him to last so long to decay, a judgment, almost certainly negative for him is expected in the fall. And his corruption is such that he is trying to pass a law to give him immunity for actions undertaken while he was not a Prime Minister, a Constitutional error according to more than 100 professors of Constitutional law.

So why is the White house apologizing ? for a change, they were not lying. Bush never apologized to the America people, to the parents of soldiers who died or were wounded in Iraq, to the world, for lying about Iraq. And the Italian People were not offended.

The world upside down…… and indeed Berlusconi can "far le corna" (see picture) if this is what his best allies think of him....
